1. Parties
These Terms of Service (“Terms”) constitute a legally binding agreement between:
Moonlit Marketing (Pty) Ltd (“Moonlit”, “we”, “us”, “our”), a company incorporated in the Republic of South Africa; and
The Customer (“Customer”, “Subscriber”, “Star”, “Seller”, “you”, “your”), being the juristic person, legal entity, or authorized individual accessing or subscribing to the Moonlit Platform.
2. Acceptance of Terms, Website Use & AI-Generated Content Notice
2.1 Binding Agreement
These Terms, together with the Privacy Policy, and any applicable Service Orders or Quotations, govern your access to and use of the Moonlit cloud platform, mobile applications, API endpoints, and affiliate services (collectively, the “Services” or “Platform”).
2.2 Website Terms of Use
By accessing or using the Moonlit website, documentation, web portals, or digital services, you acknowledge and agree that such use constitutes full acceptance of these Terms. If you do not agree, you must immediately discontinue use of the Website and Platform.
2.3 Errors, Omissions & Reader Validation
While Moonlit endeavors to provide accurate and reliable information, the Website may contain errors, inaccuracies, omissions, or typographical mistakes. You accept full responsibility for independently validating any statements, specifications, pricing, or representations before relying on them.
2.4 Artificial Intelligence (AI) Content Disclaimer
Moonlit uses automated artificial intelligence (“AI”) tools during the creation, drafting, and updating of certain website content, documentation, and platform materials. Accordingly:
• AI-generated content may contain errors, hallucinations, or unintended references.
• Moonlit does not represent AI-generated content as authoritative or complete.
• You accept full responsibility for independently verifying any AI-assisted content.
• No reliance may be placed on AI-generated content for factual, comparative, legal, or commercial decision-making.
This clause is provided without admission of wrongdoing and solely to clarify the nature of automated content generation.
2.5 Legal Capacity
If you access the Services on behalf of a company, trust, partnership, or other entity, you warrant that you are duly authorized to bind that entity.
2.6 Statutory Framework
These Terms are governed by South African law, including:
• Electronic Communications and Transactions Act 25 of 2002 (“ECTA”)
• Protection of Personal Information Act 4 of 2013 (“POPIA”)
• Companies Act 71 of 2008
